Incessant Delay and Cancellation of Flights in Nigeria: Need for Proper Regulatory and Legislative Oversight

Background Issues • The aviation sector in Nigeria has been plagued by frequent flight delays and cancellations, leading to significant inconvenience for passengers while business opportunities are lost. • Just between September and October 2024 alone, airlines in Nigeria experienced significant disruptions with 5,225 flight delays and 901 cancellations out of 10,804 flights operated. These delays and cancellations accounted for 48.3% and 8.3%, respectively, of the total flights.1 • The problem is partly blameable on weak regulations and partly on poor enforcement of these regulations by the Nigerian Civil Aviation Authority (NCAA). • The brief examines the law in this regard and provides some insights into the available remedies for customers in this category and the potential for enforcement of their legal rights where the relevant airline operator does not comply with the law. Significance of the Issue • The utmost significance of resolving these issues is highlighted by a thorough analysis of delay/cancellation records, economic impacts, and regulatory responses. The regulations had been there but there has not been compliance and sanction. Recommendations: • The brief recommends appropriate strategies to address these issues within the context of an enhanced regulatory provisions especially on compensation/ remedies. • Strong legislative interventions are required due to the estimated $52.7 million annual revenue implications and the concerning frequency of delays/cancellations.2 • Legislative measures may prioritize options in legislative oversight with a view to review NCAA regulation and it would be a welcome development if the new regulations stipulates 100 per cent refund to passengers, it it’s based on self-cause.
